ah think I found what I was looking for

CHAT_MSG_SPELL_FAILED_LOCALPLAYER 

then test for "You fail to cast power word Fortitude: Target is too low level."

only because I cant work out on vanilla what level someone has to be to cast a rank 3 fort on them
